Acceptance of Terms

By creating an account, accessing the dashboard, publishing a store, or using Ark8 services, you agree to these Terms & Conditions and related policies.

Eligibility & Account Responsibility

You must provide accurate account and business information and keep it updated. You are responsible for your login credentials, staff access, and all activity under your account.

• Ark8 may suspend accounts that appear unsafe, fraudulent, abusive, or legally risky.
• You must promptly remove access for staff members who should no longer manage your store.

Merchant Store Responsibility

Merchants control the products, prices, stock, images, content, store policies, and order fulfillment shown through their storefront.

• You must not sell illegal, restricted, counterfeit, unsafe, or misleading products.
• Product descriptions, stock, pricing, delivery terms, return rules, and customer promises must be accurate.

Customer Orders & Transactions

Ark8 provides software tools for storefront, cart, checkout, order, delivery, and customer management. Unless Ark8 separately provides a managed service, the merchant remains responsible for customer service, delivery, refunds, replacements, and disputes.

Payments, Billing & Subscription

Paid plans may renew according to the selected billing cycle. Failed payments, cancellations, taxes, gateway charges, and refund requests are handled according to the active plan, payment provider rules, and applicable subscription policy.

• Ark8 does not guarantee refunds unless a refund right is clearly stated in the applicable policy.
• Third-party payment gateways may charge separate fees or apply separate settlement rules.

Acceptable Use

You must not misuse Ark8, bypass limits, attack systems, upload malware, send spam, scrape abusively, impersonate others, commit fraud, or use the platform for illegal content or activity.

Content & Intellectual Property

You retain ownership of content you upload, such as product photos, store copy, logos, and catalog data. You grant Ark8 permission to host, process, display, and transmit that content only as needed to operate the service.

• Ark8 owns its platform software, templates, interface design, brand assets, documentation, and system content.
• You must have rights to any content you upload or publish through Ark8.

Third-party Services

Ark8 may connect with payment, delivery, SMS, email, analytics, hosting, and support providers. Those services may have their own terms and policies, and Ark8 is not responsible for third-party outages beyond its control.

Service Availability

Ark8 works to keep the platform reliable, but service may be interrupted for maintenance, updates, incidents, provider outages, or security reasons. We do not guarantee uninterrupted or error-free operation.

Data & Privacy

Use of Ark8 is also governed by our Privacy Policy and Cookie Policy. Merchants are responsible for handling customer data collected through their stores lawfully and responsibly.

Limitation of Liability

To the maximum extent permitted by law, Ark8 is not liable for indirect, incidental, consequential, special, lost-profit, lost-data, or business interruption damages arising from use of the platform.

Indemnity

You are responsible for claims, losses, penalties, or disputes caused by your illegal products, misleading content, customer disputes, policy violations, or misuse of Ark8.

Termination

You may stop using Ark8 at any time. Ark8 may suspend or terminate access for policy violations, fraud, non-payment, security risk, legal requests, or activity that may harm customers, merchants, or the platform.

Changes, Governing Law & Contact

Ark8 may update these terms from time to time. Continued use after updates means acceptance. These terms are governed by the laws of Bangladesh unless applicable law requires otherwise. For legal questions, contact legal@ark8.space.
